Notice of Drivers License or Driving Privileges Suspension
Written By: Benjamin Goldman, Esq.
This is the title of a Notice you may have received from the New York State Department of Motor Vehicles. This means a court in New York State has determined that you either failed to answer a ticket, failed to appear at a court date, or failed to pay a fine for a plea-bargained disposition. If you receive this notice, you should take care of it as soon as possible.
It is important to answer this notice as soon as possible, before you go into suspension. Driving while suspended is a misdemeanor offense. You are subject to possible jail time and a permanent criminal record. Even if you do not drive until your license is clear, the suspension will be costly. Your driving abstract will show any suspension, even if the suspension lasts for one day. The suspension will remain on your driving record even if the underlying charge is dismissed or reduced to a parking ticket. A suspension on the driving record, for any reason, will cause increases in your car insurance premiums. Also, there is a mandatory $70 Suspension Termination Fee that needs to be paid to the DMV to lift a suspension. If you receive multiple tickets, you will have to pay multiple fees of $70.
If you received such a notice, it is prudent that you contact an experienced traffic ticket attorney. This is a delicate situation and should be handled properly. You want to ensure that you do not go into suspension and having an attorney deal with the court increases the odds you will avoid suspension.
Some motorists assume it is best to simply plead guilty to avoid any complications. This is usually not the wisest approach. If handled properly, you can avoid the suspension and avoid being guilty of the underlying violation. The Benjamin Goldman Law Office deals with this type of situation on almost a daily basis. Our attorneys move quickly to ensure you are not suspended and then take the legal steps to get your charges reduced or dismissed. You can contact us to discuss your case. Consultations are always free.
