VTL 1113-(a) is not a violation that is cited often. It relates to a flashing red light, a rarely used traffic control device. Basically, a flashing red-light is to be treated like a stop sign. A motorist is required to make a full stop and check for oncoming vehicles before proceeding through the intersection. A violation of VTL 1113-(a) is a three-point ticket. The fine is up to the judge, with the maximum being $150 + $93 mandatory surcharge.
Flashing red indications. Unless to make another movement permitted by other indications shown at the same time, vehicular traffic facing a circular red signal or red arrow with rapid intermittent flashes shall stop at a clearly marked stop line, but if none, then shall stop before entering the crosswalk on the near side of the intersection, or in the event there is no crosswalk, at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign.
Whether the allegations are accurate or inaccurate, you can still fight the ticket. It is not illegal or unethical to plead Not Guilty even if the charges are true.
