Vehicle & Traffic Law § 1120-(b) is a rarely issued traffic ticket. The reason is that it is mostly redundant to VTL § 1120-(a). In fact, it is unclear what circumstances are not covered by 1120-a that would make 1120-b necessary. Either way, if you plead guilty or are found guilty of violating VTL 1120B you will get three points on your New York State driving record. The fine is determined by the judge with $150 + $93 mandatory surcharge being the maximum fine for a first-time offense. Any conviction will appear on the driving record and as such your insurance company will likely increase your insurance premiums for several years.
In addition, upon all roadways, any vehicle proceeding at less than the normal speed of traffic at the time and place and under the conditions then existing shall be driven in the right-hand lane then available for traffic, or as close as practicable to the right-hand curb or edge of the roadway, except when overtaking and passing another vehicle proceeding in the same direction or when preparing for a left turn at an intersection or into a private road or driveway.
Any motorist that receives a traffic ticket can dispute the ticket regardless of whether the charges are accurate, partially accurate, or inaccurate. Pleading Not Guilty to charges that are entirely accurate is not illegal or even unethical because a Not Guilty plea does not mean you are stating that the charges are not accurate. Rather, a Not Guilty means you are notifying the Court that you are availing yourself of your Constitutional rights to require the government to prove their case.
