VTL § 1125(a)2 “Drove to Left on Railroad Crossing”

It is rare to get a ticket for violating Vehicle & Traffic Law § 1125(a)2. The violation relates to the general requirement that with multiple lanes in one direction motorists keep to the right. VTL 1125(a)2 puts additional requirements on drivers to be in the right lane when approaching or crossing a train crossing. If convicted of 1125(a)2 you will get three points on your driving record and expect to see increased car insurance rates. The exact fine is up to the judge with the maximum at $150 plus a $93 mandatory state surcharge.

Fighting a Traffic Ticket

New York State law allows attorneys to go to court in the place of their clients. The Defendant would just have to sign a form that allows their attorney to enter a plea on their behalf. This means you can get your charges reduced or dismissed without having to leave your home or take off from work. When considering retaining a law firm for your traffic ticket there are two important things to look for. (1) The percentage of the potential law firm’s practice that is dedicated to Traffic Law. The number should be at least 75%. (2) Where the law office is located in proximity to the courthouse that is adjudicating your ticket. Some courts are in rural locations and it is difficult to find a local attorney. If you got a ticket in a city, there will likely be many local attorneys willing to take on your case.
