Not to be conflated with VTL § 1160(c).
One of the rarest violations cited in New York State is § 1166-c. This violation is similar to VTL § 1160-c, which relates to making a left turn from one street to another street. 1166-c concerns making a left turn from a one-way street to a driveway.
A conviction, whether by guilty plea or trial, will result in two points on the driver’s license. In New York City, in which cases are adjudicated by the Traffic Violations Bureau, the fine is $138. In towns and villages, the fine is determined by the judge that is assigned to the case. The minimum is $150 + $93 mandatory state surcharge. In city courts, the surcharge is $88. The fine is relatively low, but the biggest cost is the motorist’s insurance premiums. Insurance companies are inclined to raise the bi-annual rates With such a violation appearing on the driving record.
Text of the statute:
Required position for turning at alley, driveway, private road or onto property off the roadway. The driver of a vehicle intending to turn from a roadway into an alley, driveway, private road or onto property off the roadway, shall approach the turn as follows:
(c) Left turns from other than two-way roadways. The approach for a left turn from a roadway on which traffic is restricted to one direction shall be made in the extreme left-hand lane lawfully available to traffic.
All traffic charges can be disputed irrelevant to whether the allegations are accurate or inaccurate. Pleading Not Guilty to a traffic ticket, even if the allegations are correct, is not immoral or illegal. When you plead Not Guilty it does not mean you are making factual assertions. It just means you are utilizing your given rights to require the government to prove the case.
Instead of going through the burden of establishing and proving all the elements of the violation, the government (officer or prosecutor) will present a plea bargain offer. In exchange of pleading guilty to a lesser violation the original charge will be withdrawn. A traffic ticket law firm can be of essential help in such situations. An experienced traffic ticket attorney has the best chance of getting you the best possible plea offer. Also your attorney can make any necessary court appearances in your place.
